Sherk still considering action against California

The ongoing battle between former UFC lightweight champion Sean Sherk and the state of California may not be down for the count just yet as the Minnesota native confirmed his focus for now is on B.J. Penn, but he may revisit legal action at some point down the road.
“Right now, basically, I was cleared to fight, had a date in mind, had a goal in mind and so I just wanted to first off get this fight out of the way and get my career back on track,” said Sherk during a recent appearance on MMAWeekly Radio. “And there’s no statute of limitations as far as how long I have to do this thing by, so I’m still talking to my lawyer. We’re still working some stuff out, and after this fight, maybe that’s something that we can go back to.”
During the interview, Sherk reaffirmed his previous statements about never fighting in the state of California again after his treatment during the suspension and subsequent hearings with the state’s athletic commission.
“I’ve got no desire to fight in California,” Sherk stated. “The UFC’s fighting all over the country now. They’re coming here to Minneapolis in a few months, so I’ve just got no desire to fight in California now. I don’t like the way I was treated and fool me once shame on you, fool me twice shame on me, right?”
While the former champ admits he doesn’t know all of the individual grievances other promotions have with California, he believes things will have to change in the future or the state may lose some MMA business.
“I think they really need to handle things a little better and if they don’t, I think the shows are going to go elsewhere,” he commented. “This sport is so big now, you don’t need to fight in California anymore. It was something they needed to do at one point in time, where as now I think they can pretty much sell out wherever they go. It’s not a necessity anymore.”
The situation will continue to simmer on the back burner until Sherk completes his comeback at UFC 84 on May 24 against B.J. Penn in Las Vegas.

"Maybe its something we can go back to" and I basically have forever (no statute of limitations) to do it, just doesn't sound very convincing, it actually sounds very Kurt Angle-ish, when I can fit it in between wrestling mma is something we can look into, ha ha ha.

I am sure he wants to get a few fights in to put some coin back in his pocket and then I think he might attack this thing head on.

If he is really a victim of being false positive...i think Sherk has a right to file charges againts CSAC.

Absoloutely he does, but I think if he knows he did it, nothing will ever happen, there will always be some reason it does not happen, the fight with Penn, focused on the next fight, taking time off, training etc. We'll see.

Hes lucky he got his suspension cut in half. At this point I think he needs to just let it go and move forward. Theres a man from Hawaii that wants to knock him back down the hill.

Whether or not he did the steroids, Sherk wants to clear his name - or at least he wants to have his attempt to clear his name be part of the public record. He first suggested, if I remember correctly, that if he did indeed test positive, then he did not knowingly ingest banned substances. If that's the case, it doesn't indicate impropriety on the part of the commission, IMO.

This would cost him more time and effort than the gain he would get out if it. It would be in Sherk's best interest to stop brining it up so that people will forget about it.
Fuck lots of other fighters have gotten busted for steroids and the public has all but forgotten (Sylvia, Bonnar, Barnett...) but Sherk keeps dragging it back into the spotlight.
Anyways Sherk would probably need to prove that it was a false positive and not a tainted supplement, which is going to be very difficult and costly (if possible) at this point.

Tim Sylvia tested positive for steroids, was stripped of the belt, he admitted, and went on to fight his way back up and win back the belt. Sherk you tested positive and they went light on you reducing your sentence. Hermes Franca tested positive too and he owned it and didn't get his supension reduced. Move on.

he's got no leg to stand on... this is all posturing. he cheated and he knows it, i'd respect him more if he just moved on.
